{"id":752,"date":"2023-08-04T06:52:08","date_gmt":"2023-08-04T06:52:08","guid":{"rendered":"https:\/\/fr.colaw.uobaghdad.edu.iq\/?p=752"},"modified":"2023-08-25T00:17:49","modified_gmt":"2023-08-25T00:17:49","slug":"la-faculte-de-droit-discute-dune-these-de-doctorat-sur-le-don-dargent-commun","status":"publish","type":"post","link":"https:\/\/fr.colaw.uobaghdad.edu.iq\/?p=752","title":{"rendered":"La Facult\u00e9 de droit discute d&#8217;une th\u00e8se de doctorat sur le don d&#8217;argent commun"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column][vc_column_text]<\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 18px;\">La facult\u00e9 de droit de l&#8217;Universit\u00e9 de Bagdad a discut\u00e9 d&#8217;une th\u00e8se de doctorat dans la branche de droit priv\u00e9 de l&#8217;\u00e9tudiant Hassan Muhammad Hassan, intitul\u00e9 (le don de l&#8217;argent commun &#8211; une \u00e9tude comparative), sous la direction du Prof. Dr. Hamid Sultan Ali, le mercredi 2\/8\/2023 dans la salle d&#8217;audience mod\u00e8le au coll\u00e8ge.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 18px;\">Cette th\u00e8se a pour objectif d&#8217;\u00e9tudier ce q<span class=\"HwtZe\" lang=\"fr\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">u&#8217;est le don d&#8217;argent commun dans la loi islamique et en expliquant ses piliers, en clarifiant les dispositions du don d&#8217;argent commun. <\/span><\/span><\/span>Identifier les dispositions du don d&#8217;argent commun, clarifier la port\u00e9e du don d&#8217;argent commun dans son type mat\u00e9riel et moral, et les actions des associ\u00e9s, mettre en \u00e9vidence la compatibilit\u00e9 entre la jurisprudence islamique et le droit civil en mati\u00e8re de don de argent commun.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 18px;\">La th\u00e8se comprenait \u00e9galement deux chapitres, le premier traitant de la subjectivit\u00e9 du don d&#8217;argent commun, tandis que le deuxi\u00e8me chapitre traitait des dispositions du don d&#8217;argent commun.<\/span><\/p>\n<div class=\"UdTY9 WdefRb\" style=\"text-align: justify;\" aria-hidden=\"true\" data-location=\"2\">\n<div class=\"lRu31\"><span style=\"font-size: 18px;\"><span class=\"HwtZe\" lang=\"fr\"><span class=\"jCAhz ChMk0b\"><span class=\"ryNqvb\">Les principales recommandations de l&#8217;\u00e9tude<\/span><\/span><\/span> consistent \u00e0 modifier le texte de l&#8217;article (66) de droit civil et \u00e0 remplacer le texte suivant : (les droits financiers sont soit en nature, personnels ou intellectuels). Les droits communs s\u2019appliquent aux droits mentionn\u00e9s ci-dessus au premier alin\u00e9a du pr\u00e9sent article et sauf stipulation contraire.
