La Facult\u00e9 de droit de l\u2019Universit\u00e9 de Bagdad a soutenu, le 15 juillet 2026, une th\u00e8se de doctorat intitul\u00e9e \u00ab L\u2019intervention l\u00e9gislative dans la volont\u00e9 contractuelle : \u00e9tude comparative \u00bb, pr\u00e9sent\u00e9e par Mme Zainab Mohammed Najm (D\u00e9partement de droit priv\u00e9).<\/strong><\/span><\/p>\n

La th\u00e8se analyse les limites du principe de l\u2019autonomie de la volont\u00e9 \u00e0 la lumi\u00e8re des interventions du l\u00e9gislateur visant \u00e0 prot\u00e9ger l\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral et les int\u00e9r\u00eats priv\u00e9s, \u00e0 travers une \u00e9tude comparative des droits irakien, \u00e9gyptien, fran\u00e7ais.<\/strong><\/span><\/p>\n

La th\u00e8se est organis\u00e9e en trois chapitres, qui portent sur le principe de l\u2019autonomie de la volont\u00e9, les interventions l\u00e9gislatives lors de la formation du contrat et celles intervenant au stade de son ex\u00e9cution.<\/strong><\/span><\/p>\n

La th\u00e8se conclut notamment que l\u2019intervention du l\u00e9gislateur dans la volont\u00e9 contractuelle doit demeurer exceptionnelle, que certaines obligations l\u00e9gales peuvent renforcer l\u2019efficacit\u00e9 pratique du contrat, et que les exceptions au principe de la force obligatoire du contrat doivent rester strictement limit\u00e9es afin de garantir la s\u00e9curit\u00e9 juridique et la protection des droits des parties.<\/strong><\/span><\/p>\n
