intitul\u00e9e \u00ab L\u2019impact de la coutume sur le contrat : \u00e9tude comparative \u00bb, pr\u00e9sent\u00e9e par Mme Zahraa Salman Anad.<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"font-size: 18px; font-family: 'Times New Roman';\">La th\u00e8se vise \u00e0 \u00e9laborer une th\u00e9orie int\u00e9gr\u00e9e de la coutume contractuelle et \u00e0 mettre en \u00e9vidence son r\u00f4le dans la conclusion, l\u2019ex\u00e9cution, l\u2019extinction, l\u2019interpr\u00e9tation et la qualification des contrats.<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"font-size: 18px; font-family: 'Times New Roman';\">La th\u00e8se est structur\u00e9e en trois chapitres : la notion de coutume dans le contrat, l\u2019effet de la coutume suppl\u00e9tive et l\u2019effet de la coutume interpr\u00e9tative.<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"font-size: 18px; font-family: 'Times New Roman';\">Parmi les principales recommandations figurent :<\/span><\/strong><strong><span style=\"font-size: 18px; font-family: 'Times New Roman';\"> l\u2019unification de la terminologie juridique en adoptant uniquement le terme \u00ab coutume \u00bb dans les textes l\u00e9gislatifs ; <\/span><\/strong><strong><span style=\"font-size: 18px; font-family: 'Times New Roman';\">l\u2019harmonisation de la hi\u00e9rarchie entre la loi, la coutume et l\u2019accord des parties ; <\/span><\/strong><strong><span style=\"font-size: 18px; font-family: 'Times New Roman';\">la modification de l\u2019article 587 du Code civil irakien afin de le rendre conforme \u00e0 l\u2019article 583 concernant les frais de livraison du bien
