La Facult\u00e9 de Droit de l\u2019Universit\u00e9 de Bagdad a soutenu, le 18 juin 2026, une th\u00e8se de doctorat intitul\u00e9e \u00ab L\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral pr\u00e9ventif dans l\u2019activit\u00e9 juridictionnelle \u00bb, pr\u00e9sent\u00e9e par Mme Asmaa Dawood Salman.<\/span><\/strong><\/span><\/p>\n

La th\u00e8se vise \u00e0 mettre en lumi\u00e8re le r\u00f4le de l\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral pr\u00e9ventif dans le renforcement des pouvoirs du juge pour assurer la bonne administration de la justice, \u00e9viter les proc\u00e9dures inutiles et pr\u00e9server l\u2019\u00e9quilibre entre les droits des parties et l\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral.<\/span><\/strong><\/span><\/p>\n

La th\u00e8se est structur\u00e9e en trois chapitres portant sur le fondement de ce pouvoir, ses manifestations et ses effets juridiques.<\/span><\/strong><\/span><\/p>\n

Parmi les principales recommandations figurent la modification de certaines dispositions du Code de proc\u00e9dure civile irakien afin d\u2019\u00e9tendre les cas de nullit\u00e9 des actes judiciaires irr\u00e9guliers et de permettre aux tribunaux de regrouper les affaires connexes, soit d\u2019office, soit \u00e0 la demande des parties.<\/span><\/strong><\/span><\/p>\n
