Elle met en \u00e9vidence les limites du principe de la r\u00e9paration int\u00e9grale du pr\u00e9judice et souligne la n\u00e9cessit\u00e9 de renforcer la fonction dissuasive de la responsabilit\u00e9 civile.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 18px; font-family: 'Times New Roman';\"><strong>La th\u00e8se recommande notamment d\u2019\u00e9largir le champ de l\u2019indemnisation en droit irakien afin d\u2019y int\u00e9grer une dimension punitive et dissuasive, de renforcer le pouvoir d\u2019appr\u00e9ciation du juge et de prendre en compte les consid\u00e9rations \u00e9conomiques lors de l\u2019\u00e9valuation du montant des dommages-int\u00e9r\u00eats.<\/strong><\/span><\/p>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column]<div id=\"cz_89138\" class=\"cz_grid_p cz_89138\"><div class=\"cz_grid cz_grid_1 clr
