Le d\u00e9partement de droit priv\u00e9 de la Facult\u00e9 de Droit de l\u2019Universit\u00e9 de Bagdad a organis\u00e9 un colloque intitul\u00e9 \u00ab L\u2019action en justice comme moyen de protection des droits de l\u2019h\u00e9ritier \u00bb. Anim\u00e9e par le Professeur (Dr. Hamid Sultan Al-Khalidi), avec la participation des \u00e9tudiants en \u00e9tudes sup\u00e9rieures. Le mardi 26 novembre 2024.<\/strong><\/span><\/p>\n

Le colloque avait pour objectif de mettre en lumi\u00e8re la protection offerte par les l\u00e9gislations \u00e0 l\u2019h\u00e9ritier recevant un patrimoine, en expliquant les types d\u2019actions en justice, leurs conditions et leurs r\u00e8gles.<\/strong><\/span><\/p>\n

Plusieurs axes ont \u00e9t\u00e9 abord\u00e9s :<\/strong><\/span>
\n1. La notion g\u00e9n\u00e9rale de l\u2019action en justice et celle sp\u00e9cifique \u00e0 l\u2019h\u00e9ritage, ainsi que leurs conditions.<\/strong><\/span>
\n2. Les diff\u00e9rents types d\u2019actions prot\u00e9geant les droits des h\u00e9ritiers et leurs particularit\u00e9s.<\/strong><\/span><\/p>\n

Le colloque a conclu avec plusieurs recommandations, notamment :<\/strong><\/span>
\n\u2022 R\u00e9duire les erreurs mat\u00e9rielles et proc\u00e9durales dans les actes de partage successoral en v\u00e9rifiant les d\u00e9tails, le nombre d\u2019h\u00e9ritiers et leurs situations avant l\u2019\u00e9mission des documents.<\/strong><\/span>
\n\u2022 Encourager le l\u00e9gislateur irakien \u00e0 respecter les dispositions explicites du Coran et de la Sunna concernant les partages successoraux, ces textes \u00e9tant clairs et ne laissant pas place \u00e0 l\u2019interpr\u00e9tation.<\/strong><\/span><\/p>\n
